Driver Terms & Agreement

These Driver Terms govern your participation as an independent driver on the SPARKLLEX platform, operated by SPARKLLEX LLC.

1. Acceptance of these terms

By registering as a driver and using the SPARKLLEX Driver app, you accept these Driver Terms in addition to the general Terms and Conditions and the Privacy Policy.

2. Independent contractor relationship

You provide delivery services as an independent contractor, not as an employee, agent or partner of SPARKLLEX LLC. You control your own schedule, vehicle and how you perform deliveries within the service standards described in these terms.

3. Eligibility and verification

  • You must meet the minimum age and licensing requirements of your market.
  • You must provide accurate identification, license and vehicle documents.
  • You must pass the background and document verification required before going online.
  • You must keep your documents current and notify us if any of them expire or change.

4. Using the Driver app

  • You choose when to go online and offline; there are no fixed shifts or minimum hours.
  • Once you accept a delivery, you are expected to complete it or cancel promptly if you cannot.
  • You must follow the pickup, navigation and delivery instructions shown in the app.
  • You must treat customers and businesses with respect and follow applicable traffic and safety laws.

5. Proof of delivery

Depending on the delivery type, you must confirm completion with a photo, PIN, signature or GPS timestamp as required by the app. A delivery is not considered complete until proof of delivery is submitted.

6. Payments and earnings

Your earnings per delivery are shown in the app before and after you accept it. Payouts are made to your SPARKLLEX Pay account or linked bank account on the schedule shown in the app, less any applicable fees disclosed to you.

7. Vehicle and insurance

You are responsible for maintaining your vehicle in safe operating condition and for carrying the insurance and permits required by law in your market. SPARKLLEX LLC does not provide vehicle insurance and is not a party to your insurance policy.

8. Suspension and termination

We may suspend or deactivate your driver account if you violate these terms, provide false information, receive repeated valid complaints, or engage in unsafe or fraudulent conduct. You may stop using the Driver app at any time.

9. Data and privacy

Your personal, location and document data is processed as described in our Privacy Policy.

10. Changes to these terms

We may update these Driver Terms. The current version is always available on this page, and material changes will be communicated in the app.

11. Governing law

These Driver Terms are governed by the laws of Massachusetts, United States.
